Security Deposit Tips & Warnings

Your tenant has moved out and wants their security deposit refunded. However, you notice that there is a bit more wear and tear on the unit than is normal. How do you decide how much money to refund to them?

• Security deposit is intended to cover damage to the unit. You may not legally deduct late rent fees and past due rent.
• You may charge for cleaning and hauling away garbage and items that were left behind.
• Do not be greedy. Only charge for what is broken due to neglect or excessive wear. If a carpet shows wear and is seven years old, you should not charge for it. If a ten year old refrigerator is on its last leg do not charge the tenant to replace it.
• Document all damages and repairs in case the tenant tries to sue you for return of the deposit.
